Columbus, Ohio Social Security Disability Attorneys

Barkan Meizlish DeRose Cox, LLP, has advised and represented Social Security Disability Income (“SSDI”) and Supplemental Security Income (“SSI”) applicants from across the United States since 1960. In fact, Our attorneys were among the first to focus on helping the most-vulnerable members of society take on the Social Security disability program.

Ohio residents who become permanently disabled may be eligible to apply for SSDI or SSI through the federal government. These programs provide a monthly benefit and access to medical insurance for individuals who are unable to work, due to physical and/or mental disability.

Unfortunately, the Social Security Administration denies a large percentage of applications for SSDI and SSI. Receiving federal long-term disability benefits and supplemental income often requires fighting through multiple appeals. A disabled person may even need to go to court to secure benefits. Our social security disability attorneys have successfully represented hundreds of clients from appeals through the hearing process.

Who Can Apply for SSDI Benefits?

Social Security Disability Insurance (SSDI) is available to people who were born with significant disabilities and/or people who become permanently disabled later in life.

To qualify, a person must, with few and very specific exceptions:

  • Be a U.S. citizen,
  • Have paid into the Social Security system or be the child or legal defendant of someone who has, and
  • Suffer from a physical or mental condition that has kept or will keep them out of work for at least 12 months or is likely to result in death.

A qualifying disability can result from any cause, but it must significantly limit a person’s ability to perform any type of work in the national economy. Work-related injuries or occupational illnesses that keep people off the job for less than a year are most properly handled by private insurance policies and the Ohio workers’ compensation program.

Treatment history, medical information, employment history, and details on education and training must be submitted with the basic application for federal disability benefits. Many applicants for Social Security Disability benefits may also be subjected to a physical or mental assessment that is conducted by a health care provider chosen by the Social Security program.

Who Might Qualify to Receive SSI?

Supplemental Security Income is strictly a needs-based program. To qualify for supplemental income, a person must suffer from a physical or mental condition that has lasted or will last for 12 months, or is likely to result in death. Additionally, the individual must provide information on household income and expenses, investments and savings, and assets, including vehicles and homes. Call attorney today for a free case review.

Disabled individuals often qualify for both types of benefits and applications for SSDI and SSI benefits can be submitted at the same time. Consulting a SSDI/SSI attorney will help you to determine which applications are appropriate for your situation.
