Facebook is very popular; over a billion people use Facebook every day. But there are real legal dangers in using and posting on Facebook. Facebook is a public site, which means that what you post in Facebook can be used in discovery. Nothing prevents an ALJ from looking at your Facebook page. Even innocent posts, may be subject to misinterpretation. A picture of you fishing, taken prior to your injury, but posted afterword, can place the seed of doubt in an ALJ’s mind that you are not really as limited as you say you are.
Our advice is: be careful about what you post because your friends are not the only ones who have access to it.
