The law firm Barkan Meizlish, LLP, along with Nichols Kaster, PLLP and Miller, Hampton, & Hilgendorf recently filed a collective action against Simon Roofing and Sheet Metal Corp. (“Simon Roofing”), a company that holds itself out as “one of the nation’s largest and most vertically integrated commercial roofing companies.” The lawsuit, Warren v. Simon Roofing and Sheet Metal Corp., (Case No. 4:15-cv-359) was filed in the United States District Court for the Northern District of Ohio on behalf of all employees who worked for Simon Roofing as roofers, roofing foreman, field support technicians, or other similar positions over the past three years. The Complaint asserts that Simon Roofing violated the Fair Labor Standards Act (“FLSA”) by failing to include “travel time” and the hours worked prior Plaintiff’s first job site in the weekly overtime pay calculation. The Plaintiff seeks to recover unpaid overtime wages and liquidated damages for himself and all similarly situated current or former employees of Simon Roofing at any time over the past three years.
