COMPLAINT FILED AGAINST TEAM LUBRICATION, INC, DBA JIFFY LUBE FOR UNPAID WAGES SUSTAINED BY CURRENT AND FORMER EMPLOYEES

CENTRAL OHIO, SEPTEMBER 30, 2019 – Attorneys with Barkan Meizlish DeRose Wentz McInerney Peifer, LLP filed a federal collective class action Complaint against Team Lubrication, Inc, DBA Jiffy Lube. The automotive franchise services six locations throughout Central Ohio. As stated in the Complaint, employees across the region completed training modules without proper compensation for their time. Additionally, the employees changed in and out “Don and Doff” their required safety gear off the clock, leading to additional unpaid wages.

Barkan Meizlish, LLP is bringing this suit forward on behalf of both current and former Team Lubrication DBA Jiffy Lube technicians. The Fair Labor Standards Act, 29 U.S.C. §§ 201 et seq. (“FLSA”) and the Ohio Minimum Fair Wage Standards Act, O.R.C. §§ 4111 et seq. (“Ohio Wage Act”) sets guidelines on proper overtime pay for qualifying employees. The laws require employees be paid at least $8.55 per hour in 2019, and at an overtime pay rate of 1.5 times the employees regular rate for all hours worked over 40 hours. The Complaint covers the former and current technicians at Team Lubrication, Inc, DBA Jiffy Lube were paid  less than the Ohio minimum wage and not properly compensated for all of their overtime hours worked. Specific violations include:

  1. Unpaid, mandatory training (“Jiffy Lube University” and “J-Team Training”) prior to beginning work at Central Ohio Jiffy Lube locations
  2. Off-the-clock time spent changing into mandatory uniforms and safety gear

Plaintiffs’ attorney, Robert E. DeRose, official statement:

“Wage theft in any form cannot be tolerated. These types of wage violations are far too common in the workplace. Workers should not have to go to the courts to be paid their fair wages.  We intend on securing the unpaid wages and overtime for the current and former workers of Team Lubrication with this lawsuit.”
